Throughout my experience, from my work in the Legislative Assembly of the Federal District to my collaboration with developers like Homex, I have observed that the lack of knowledge and adequate documentation are the main obstacles to making the most of the opportunities that a piece of land can offer. In this article, I will cover the key steps to ensure that a piece of land is properly assessed and managed, from reviewing documents to analyzing its feasibility for future development.

 

1. Know the terrain: the first step


The first step is to know it in its entirety, it is like when you get married and you want to know everything about your future partner. This not only involves a physical understanding of the space, but also a thorough review of its legal and documentary status. In my experience, many owners are not aware of the importance of keeping their documentation in order, which can lead to significant complications at the time of a transaction or development.

Basic documentation required


The basis of any secure transaction is having a public deed with registration data in the Public Property Registry. During my time in the Legislative Assembly, I learned that any modification (no matter how minimal) in land use requires an in-depth review by various institutions. This review would be unnecessary if both the architect and the owner were fully aware of the legal status and possibilities of their land from the beginning.


Many lands for sale, especially in rural or semi-urban areas, are under a parcel certificate, a document that does not represent private property, but rather a right over ejidal lands. In these cases, a regularization process is necessary before the National Agrarian Registry, which involves the transformation of the land from social property to private property, a procedure that includes the convocation of an ejidal assembly and the issuance of various legal documents such as rights of interest, which could destroy an agreed acquisition.

Property regularization


I have worked with many owners who did not know the exact boundaries of their land or who did not have their documentation up to date, turning on red lights, since regularization is urgent. For example, a parcel certificate must be converted into a property title so that the land can be deeded and registered in the Public Property Registry. This process, which can be assisted by a lawyer specialized in agrarian law, is essential to ensure the security of any future transaction.


Another recurring document of the seller is the administrative registration, a procedure that allows land that was not previously registered to be registered for the first time in the Public Property Registry. This process requires the presentation of witnesses and a detailed evaluation to finally issue a valid public deed, but there is a risk that the real estate investment will be unable to obtain bank credit due to this background.

 

2. Technical evaluation: surveys and analysis


Once the documentation is in order, the next step is to carry out a technical analysis of the land that includes a topographic survey that confirms the dimensions and physical characteristics of the land (boundaries and boundaries). It is common to find differences between the registered surface and the real one, which may require a cadastral update and, in some cases, the preparation of a survey and demarcation (cadastral or judicial, in extreme cases).

There is a high probability of negotiating with neighbors and settler associations, as well as establishing relationships with local authorities to obtain permits and licenses.

And I recommend ignoring appraisals with conflicts of interest and involving the seller in the negotiations in order to know their interests and for both parties to achieve their goals.
